Terms of use

1.1 The terms of use of the e-store (the “Terms”) apply to all legal relationships, offers of products (the “Product”), orders, sales transactions that take place between the user of the e-store (the “Customer”) and the e-store kix.ee (“E-shop”) owner Kixperience OÜ (“Web Store”), registry code 14258877, business address Tehnika 21, Tallinn 10146 Estonia, sometimes.

 

1.2 In addition to the Terms and Conditions, the legal relations arising in the course of using the E-store are regulated by the legislation of the Republic of Estonia.  

 

1.3 The Online Store may change the Terms at any time. Changes to the terms and conditions will be published on the website kix.ee and shall take effect immediately upon publication. By using the e-shop and placing an order through it, the Customer confirms that he has agreed to the Terms.  

 

 

2. Prices

 

2.1 The prices of the e-store are given in euros and include VAT valid in Estonia (20%).

 

2.2 Prices do not include shipping costs. Shipping costs will be displayed in the online store before the purchase is made, so that the Customer can read them.

 

2.3 If the Customer orders the Product outside the European Union, the Product may be subject to import obligations and duties payable upon arrival of the Product in the country of destination. Such taxes are paid by the Customer. The tax and customs policy may differ from country to country, therefore the Online Store recommends that the Customer read any additional taxes before ordering the Product.  

 

2.4 The Online Store may change the prices displayed in the E-Store at any time. All changes will be published on the kix.ee website and will take effect from the moment of publication.  

 

2.5 If the Customer's order is submitted before the price change is published, the price valid at the time of making the purchase shall be applied to the Customer.  

 

 

3. Ordering and payment terms

 

3.1 To place an order, the Customer selects a suitable Product from the online store and clicks the “Add to Cart” button on the Product page. Then, by clicking the "Make a purchase" button, you can view, change and remove the products in the shopping cart. On the same page, you can choose the appropriate delivery method and view the shipping costs.   

 

3.2 When placing an order, the Customer enters his / her data - name, e-mail address, company name (if the invoice goes to the company), shipping address and telephone. Correctly entered delivery information ensures that the product reaches the Customer quickly and without any problems.  

 

3.3 It is possible to pay for the product either by transfer (on the basis of an invoice), with Paypal. The customer pays 100% of the product price when confirming the order.  

 

3.4 The Agreement is entered into from the moment the payment reaches the current account of the Online Store.  

 

 

4. Product delivery

 

4.1 The Online Store delivers the Product to the Customer by registered mail or parcel machine service. In addition, it is possible to pick up the product yourself (address Tehnika 21, Tallinn at agreed times). The online store notifies the Customer by e-mail when the product has been launched (and provides the package tracking code) or may be picked up.  

 

4.2 Delivery takes a few working days within Estonia, 7-9 days in Europe and 21 days elsewhere in the world. These deadlines are informative. If the product has not arrived by then, contact the Online Store.  

4.3 The online store is not responsible for delays or problems that have arisen due to the inaccuracy of the data entered by the Customer when placing an order.  

 

 

5. Product return

 

5.1 After receiving the product, the Customer has 14 days to get acquainted with the Product. If the Customer is not satisfied with the Product for any reason, the Customer has the right to return the Product within 14 days by notifying the Online Store at the e-mail address info@kix.ee.

 

5.2 The returned Product must be in the original packaging and in the same condition as when it reached the Customer. The product must be unused, ie the product must not have any signs, marks or damages that were not present when the product reached the Customer. Products returned with traces of use will not be accepted by the Online Store and will be returned to the Customer.  

 

5.3 If the Customer returns the Product in accordance with the terms of clauses 5.1 and 5.2, the Online Store will return the cost of the product to the Customer (shipping costs will be borne by the customer). The cost of the Product will be returned to the Customer no later than within 14 days from the moment the Customer has submitted the return application to the Online Store, provided that the returned Product itself reaches the Online Store within that time (ie 14 days).  

 

5.4 The Online Store reserves the right to terminate the contract if the Product ordered by the Customer cannot be produced or if the Product was ordered at the time when the Typographic error occurred in the E-store regarding the price of the Product. If the contract is terminated, the Customer will be notified by e-mail and the money will be returned to the Customer as soon as possible, but not later than within 30 days from the ordering of the Product.

 

 

6. Copyright

 

6.1 The content of the E-Store, including texts, graphics, logos, images, videos and audio, is protected by copyright, which belong entirely to the Online Store.  

 

6.2 It is prohibited to reproduce, copy, modify or otherwise use such copyrighted content referred to in clause 6.1 without reference to the Online Store.  

  

 

7. Use and protection of personal data

 

7.1 The Customer consents to the processing of his / her personal data by the Online Store.

The data entered by the Customer when submitting the order is stored by the Online Store for the purpose of fulfilling the Product order submitted by the Customer and developing the service offered to the Customer by the Online Store.  

 

7.2 The personal data to be registered includes the data on the Customer's order - the Customer's name, company name (if applicable), address, e-mail address, telephone number, payment method used and data on the selected product.  

 

7.3 The Online Store may transmit the Customer's personal data, which is necessary for the delivery of the Product to the company providing the courier service.  

 

7.4 The protection of personal data is guaranteed by all security measures required by law.

The online store does not transfer registered personal data to third parties, except in cases prescribed by law.  

 

7.5 The Customer has the right to check the personal data concerning him / her and to request that they be changed or that his / her personal data be deleted from the database.  

 

7.6 With the consent of the Customer, the Online Store may send sales offers, newsletters, inquiries and other notices to the Customer to the Customer's e-mail address entered when submitting the order.

 

8. Liability and Force Majeure

 

8.1 The parties shall be released from the performance of the obligations arising from and related to the contract in part or in full, if this is prevented by force majeure, and the parties are obliged to take all measures to prevent damage to the other party and ensure the performance of the contract as much as possible. Force majeure must be proved by the party who wishes to invoke these circumstances as a basis for releasing the liability arising from the law and / or the contract for non-performance or improper performance of the obligations assumed under the contract. Force majeure within the meaning of the contract is not a change in the economic situation of a party, bad weather, a rise in prices, a holiday, bankruptcy, or a warning of bankruptcy or securing an action.  

 

8.2 Any liability of the Online Store is limited to the cost of the Product.  

 

8.3 Links to other websites from the Online Store are not under the control of the Online Store and the Online Store is not liable for any damages that may occur in connection with the use of such links.

 

9. Applicable law

 

9.1 Estonian law applies to the Terms.  

 

9.2 All disputes between the customer and the Online Store will be resolved through negotiations. If a compromise is not reached, the customer has the right to apply to the Consumer Protection Board or Harju County Court.
